DUI Sentence Ranges and Conditions

1(a) Category: No Prior Offense and BAC Less Than .15 or No Test Result:

  • Jail: 24 hours consecutive (1 day) mandatory. Range is 1 to 364 days.
  • EHM: Electronic home monitoring may be available in lieu of the one day, but you must do a minimum of 15 days on EHM.
  • Dui Fine: $940.50 is the minimum. Maximum dui fine is $5,000.00. Does not include other assessments and costs.
  • Washington State Drivers License: 90 day suspension.
  • Ignition Interlock Device: Mandatory
  • Alcohol or Drug Evaluation or Treatment: As determined by the court.

1(b) Category: No Prior Offences, BAC .15 or Greater or Refusal:

  • Jail: 48 hours consecutive (2 day) mandatory. Range is 2 to 364 days.
  • EHM: Electronic home monitoring may be available in lieu of the one day, but you must do a minimum of 30 days on EHM.
  • Dui Fine: $1,195.50 is the minimum. Maximum dui fine is $5,000.00. Does not include other assessments and costs.
  • Washington State Drivers License:
  • 1 year revocation
  • 2 years if BAC test was refused.
  • Ignition Interlock Device: Mandatory
  • Alcohol or Drug Evaluation or Treatment: As determined by the court.

2(a) Category: 1 Prior Offense, BAC Less Than .15:

  • Jail: 30 days mandatory, and up to 364 days.
  • EHM: 60 days is required in addition to jail.
  • Dui Fine: $1,195.50 is the minimum. Maximum dui fine is $5,000.00. Does not include other assessments and costs.
  • Washington State Drivers License: 2 year revocation.
  • Ignition Interlock Device: Mandatory
  • Alcohol or Drug Evaluation or Treatment: As determined by the court.

2(b) Category: 1 Prior Offense, BAC Greater Than .15 or Refusal:

  • Jail: 45 days mandatory, and up to 364 days.
  • EHM: 90 days is required in addition to jail.
  • Dui Fine: $1,620.50 is the minimum. Maximum dui fine is $5,000.00. Does not include other assessments and costs.
  • Washington State Drivers License:
  • 2 year revocation
  • 3 years if BAC Refusal
  • Ignition Interlock Device: Mandatory
  • Alcohol or Drug Evaluation or Treatment: As determined by the court.

3(a) Category: 2 Prior Offenses, BAC Less Than .15:

  • Jail: 90 days mandatory, and up to 364 days.
  • EHM: 120 days is required in addition to jail.
  • Dui Fine: $2045.50 is the minimum. Maximum dui fine is $5,000.00. Does not include other assessments and costs.
  • Washington State Drivers License: 3 year revocation
  • Ignition Interlock Device: Mandatory
  • Alcohol or Drug Evaluation or Treatment: As determined by the court.

3(b) Category: 2 Prior Offenses, BAC Greater Than .15 or Refusal:

  • Jail: 120 days mandatory, and up to 365 days.
  • EHM: 150 days is required in addition to jail.
  • Dui Fine: $2,895.50 is the minimum. Maximum dui fine is $5,000.00. Does not include other assessments and costs.
  • Washington State Drivers License: 4 year revocation
  • Ignition Interlock Device: Mandatory
  • Alcohol or Drug Evaluation or Treatment: As determined by the court.

Here is a list of the other costs that you may encounter:

  • Dui cost recovery: this requires you to pay for all of the law enforcement officer’s time to arrest and write reports. This is generally around $100.00. If it is much over this, make sure to go over the cost statement in detail with your dui defense lawyer.
  • Probation fees: monthly expenses for your probation monitoring. At the time of this writing it is roughly between $20 to $40 per month. Probation for a drunk driving charge is typically 24 months. As such, your expense is likely to be between $480 to $960.
  • Treatment evaluation: an alcohol treatment evaluation usually costs around $40 to $80. Sometimes heath insurance will cover this.
  • Treatment costs: treatment programs vary in length, intensity, and cost. Expect treatment programs to cost at least a few hundred dollars for the short programs (24 hour, 3-6 months), and maybe thousands for longer more intensive programs.
  • Conviction and or filing fees: You may have to pay a conviction fee. This is generally around $43.00 or more.
  • Warrant fees: occasionally a court will require that costs for issuing and executing warrants.
  • SR-22 Insurance: You have to maintain high risk insurance.  This is more expensive.
  • Ignition Interlock Device: This device is now mandatory.  There is an installation fee and a monthly lease fee.  Rates vary, but it is around $80.00 a month.  Install is generally $50 to $100.  You will also have to pay to have it uninstall.
  • The minimum required installation is generally 1 year.
  • If you have had priors the length of time increases.  Talk to you Spokane DUI Lawyer about this.
  • Victims Impact Panel: If you are convicted of drunk driving you will be required to attend a victim’s impact panel.  Range is $30.00.
  • Geiger Work Release: You will likely have to pay to be on work release.  This cost is assessed on a daily basis. (Program Requirements Vary)
  • Drivers License Washington State Reinstatement: Approximately $125.00.
