Washington dui law is very specific when it comes to sentencing. There are 2 major issues: (1) What was your BAC or was the breath test refused; and (2) Has there been a prior dui conviction? After these two issues are addressed, you are placed into one of seven possible categories. The seventh category is felony dui. We won’t discuss felony dui in this section.
If the test for blood alcohol, commonly called “BAC”, was below a .15 you are in what we often call the “A” category. If you refused the BAC test or your blood alcohol level was more than .15 you are in the “B” category.
Next, we look at prior offenses. If you have had no prior offenses within the past seven years you are in the “1” category. You probably guessed that is you have had one prior within seven years you are in the “2” category, and then if you have had two or more prior offenses within the last seven years you are in the “3” category. Washington dui law has only one other driving under the influence category, which is felony dui. Don’t misunderstand; there are other charges that are dui related. For example, vehicular assault or vehicular homicide can be drunk driving related, but are separate charges.
You will notice, that the dui penalties are more harsh is the “B” categories, and also when you have prior driving under the influence charges.
I had a prior dui charge but it was amended to another charge? Unfortunately, for sentencing purposes that charge will probably be counted as a prior dui conviction.
